Emulators themselves are simply software that interprets and executes game code written for another platform. The key distinction lies in how emulators are used. According to Nintendo’s legal position, emulators violate copyright law only when they bypass encryption, copy copyrighted console programs, or direct users to pirated material. Even with this official acknowledgment, Nintendo has actively pursued legal action against major emulation projects such as Yuzu and Ryujinx, leading to their shutdown. Third-party forks of these emulators continue to be maintained, however.
